The Iran nuclear agreement, known as the Joint Comprehensive Plan of Action (JCPOA), represented a momentous diplomatic achievement. It put to rest a vexing, and potentially dangerous, nuclear crisis that had bedeviled the international community for more than a decade and had resulted in international sanctions against Iran while also raising the possibility of foreign military action against Iran’s nuclear facilities. The culmination of intense, marathon negotiations between Iran and several major powers discussed in the preceding chapter, the JCPOA was conceived as a win-win for the negotiating parties and a net plus for nonproliferation causes, by establishing that “Iran will not engage in activities that could contribute to the development of a nuclear device.”

Our aim in this chapter is to examine the legal status of the Iran nuclear agreement and to evaluate the different perspectives that have provided alternative interpretations of the JCPOA’s significance from the prism of international law, as a prelude to the presentation of our own perspective on this subject. This is a particularly important issue in light of the fact that US president Donald Trump had targeted the JCPOA,In a speech before a pro-Israel lobby group in March 2015, Trump stated that his “number-one priority” was “to dismantle the disastrous deal with Iran,” yet he followed that up with the promise to “enforce it like you’ve never seen a contract enforced before.” Elsewhere during his presidential campaign, Trump promised to renegotiate the Iran deal by “forcing the Iranians back to the bargaining table.”
